Lisle Cancels Village Board of Trustees Meeting

The announcement posted on the Village website does not cite a reason for the cancellation.

The Village Board normally meets on the first and third Mondays of each month. The next Village Board meeting is scheduled for 7pm on Feb 18, 2013.

The last regular meeting of the Lisle Board of Trustees was only 13 minutes long including the Pledge and rollcall. At the end of the Jan 21, 2013 open meeting, the Board held a closed session meeting to discuss "probable or eminent litigation." The Village Board did not provide to the public any information as to the nature of the litigation.

Litigation against Lisle. Interesting. The IL Attorney General recently issued an opinion regarding "litigation" asserted to to be "probable or imminent" within the meaning of the statute, saying that there must be reasonable grounds to believe that a lawsuit is more likely than not to be instituted or that such an occurrence is close at hand. IL Attorney General's opinion said that the only matters which may lawfully be discussed in closed session are the strategies, posture, theories, and consequences of the litigation itself. An Illinois Attorney General ruling in 1983 clarified that “probable or imminent” means “likely to occur.” In other words, the public body cannot simply go into closed session because the action they take or don’t take could or might result in a lawsuit. The closed session exception, according to Illinois Attorney General Lisa Madigan’s guide to the act, also does not authorize closing a meeting “merely because an attorney is present and/or legal issues are to be discussed.” http://foia.ilattorneygeneral.net/pdf/opinions/2012/12-013.pdf

Correction - the closed meeting to discuss "Probable or Eminent Litigation" was held on Jan 7, 2013 not Jan 21, 2013. The closed meeting on Jan 21, 2013 was held to discuss "Appointment, Employment, Compensation, Performance of Specific Employees."
