Court Watch: School Officials Object to Records Request in Naperville North Sex Abuse Case

Naperville District 203 officials claim releasing records of students is a violation of privacy in a case against a former Naperville North counselor, and other recent developments in DuPage and Kane County courts.

DUPAGE:
Downers Grove:
A 20-year-old Downers Grove man is expected to enter a plea agreement with prosecutors on Feb. 1 relating to charges he fondled and had sexual contact with a teen girl during the summer of 2010, according to court records. Daniel Bashaw was indicted last year on two counts of aggravated criminal sexual abuse, and was ordered to have stay away from anyone under the age of 18. A judge ordered a sex offender evaluation ahead of the Feb. 1 hearing.


Naperville:
School district officials are objecting to a request by the attorney for John Carbonaro who wants to obtain school records of two students at , where Carbonaro worked as a counselor until his arrest on sex abuse charges last year. Carbonaro's attorney sent subpoenas to the school for records of the girl who prosecutors said was fondled by Carbonaro in 2010, as well as records of a second girl, according to court documents. The district claims the request is too broad and that the records are protected from being released on privacy grounds. Carbonaro, 34, was indicted on eight counts of aggravated criminal sexual abuse in March. He returns to court Jan. 6.

KANE COUNTY:
St. Charles:
A St. Charles teen has been placed in a pre-trial diversion program in connection to his arrest last year on a charge of impersonating a police officer. Michael McSweeney was originally accused of making siren noises and yelling through a loud speaker to tell other vehicles to pull over. In an agreement with prosecutors to enter the program, McSweeney acknowledged he made "loud noises" through a vehicle's public address system while driving on Randall Road that alarmed another driver enough to pull off the road. McSweeney will spend a year in the program and must complete 50 hours of community service to avoid a conviction. A co-defendant, Jeff Stolzenberg, returns to court on Jan. 23 when he will also seek placement into the program.
