Court Watch: Elmhurst Woman Accused of Killing Grandson Needs Mental Health Treatment, Attorneys Say

A roundup of DuPage County court news.

DUPAGE:
Downers Grove:
The Downers Grove man once convicted of pretending to be a doctor, and then charged with same crime again last year, has died. DuPage County prosecutors confirmed Eugene Miller's death this week after an obituary stating he died on Nov. 13 appeared in the Chicago Tribune. Miller was scheduled for trial in January on multiple counts of practicing medicine without a license, theft and telling others he was a doctor. He was arrested and later freed on $100,000 after police investigated claims Miller told a woman he was a doctor able to treat her depression, anxiety and vomiting without the use of drugs or other medical procedures.

Elmhurst:
Local attorney Earl Wilcek, accused of stealing thousands of dollars from an estate client, now faces a lawsuit stemming from a 2009 car crash. Wilcek was cited for failure to reduce speed after a rear-end collision in November 2009 at York Road and Van Buren Street. He was given court supervision and fined in the case, records show. The other driver, Laurilyn filed a lawsuit recently claiming Wilcek was negligent and failed to brake to prevent the crash from happening. The lawsuit is scheduled for a January hearing. Wilcek's criminal case returns to court on Nov. 22.

The Elmhurst woman found not guilty by reason of insanity earlier this year in the attempted murder of her grandson needs in-patient mental health treatment, according to attorneys. An evaluation by the Illinois Department of Human Services made that determination for Sandra Clanton, who was accused of slamming her infant grandson's head on a kitchen counter and cutting him with a knife last year. Her attorney, as well as prosecutors, told Judge Daniel Guerin that they concur with the findings. Guerin set a formal hearing for Dec. 14, when Clanton will appear in court, to order her into the treatment plan.
